Battery And Sexual Assault Attorney in Louisville
The Difference Between Assault And Battery
Battery is the intentional touching of, or application of force to, the body of another person in a harmful or offensive manner (and without consent). A battery is often confused with an assault, which is merely the act of threatening or placing fear in another. An assault is usually followed by battery, but not always. Battery can be committed without an assault and vice versa. If you’ve been subject to assault or battery or both, our committed legal team at Ewing & Willis can help. Call our Louisville office at 502-585-5800.

Christopher G.
Christopher G., a 14-year-old male living with his mother in Oldham County, Kentucky, was the invited guest on the property of his neighbors, boys ages 15 and 16. Christopher’s father was next door when he heard screaming and realized that it was Christopher. Christopher’s father raced toward the direction of the screaming and came in contact with Christopher, whose entire right pants leg was completely burned off from the knee level down. Christopher stated to his father, “Dad, they set me on fire.” Christopher was treated at Kosair Children’s Hospital in Louisville, Kentucky. Christopher suffered severe burns to his right leg, arms, hands and fingers. Christopher had to undergo numerous skin grafts and was required to wear compression garments every day for over one year after the accident. Not only did Christopher suffer serious physical injury but also psychological and emotional trauma, causing depression and low self-esteem. We were retained by Christopher and his family for the personal injury negligence case against the landowners. Depositions of the neighbor boys revealed one of the boys present threw gasoline on Christopher at least three times when Christopher was unaware of it, before pushing Christopher repeatedly until he was close enough to be ignited by a bonfire. The case was mediated and a confidential settlement was reached.

Jennifer G.
Jennifer G., a 30-year-old female from Louisville, Kentucky, voluntarily admitted herself to Ten Broeck Hospital due to depression and alcohol abuse issues following a terrible break-up with her fiancée. Jennifer was placed in the co-ed adult patient unit, where she was repeatedly assured that she was in a safe environment. After approximately 10 days at Ten Broeck and days before she was to be released, Jennifer was sexually assaulted by a male patient at Ten Broeck. Not only did Jennifer incur additional medical expenses, but she suffered extensive psychological and emotional trauma. We represented Jennifer in the sexual assault action against Ten Broeck due to their negligent supervision, violation of their own policies and procedures related to patient monitoring, and insufficient policies and procedures to adequately protect patients such as Jennifer. In addition to filing the lawsuit on Jennifer’s behalf, we retained an expert on workplace safety and security specifically related to safe environments for treatment of mental health issues. The case was mediated and reached a confidential settlement.
