Corey G., a 14-year-old student at Graves County High School, in Graves County, Kentucky, was injured during school hours while under the exclusive supervision of school employees. Due to the negligence of the school and its employees, Corey suffered a terrible injury to his left leg and knee when another student tackled and fell on Corey during an unofficial football game initiated during school hours as a “privilege” for the students who had completed all school work. No safety equipment was provided for the game. Corey suffered a fracture and was given a knee immobilizer and crutches. Further diagnostic testing revealed a medial collateral ligament tear, and Corey’s doctor opined that repair surgery was necessary. Corey underwent orthopedic surgery to repair his left leg and knee, specifically open reduction internal fixation of the left distal femur with three screws. Due to ongoing pain after surgery and physical therapy, Corey underwent a second surgery to remove the hardware. I was hired by Corey and his family for his premises liability action against Graves County High School and its insurance carrier, Ohio Casualty insurance company. The case was mediated and reached a confidential settlement.
