Upon seeking medical treatment, it was revealed that she had a fractured wrist and a broken finger. In addition, she had to undergo significant physical therapy. The insurance company for the restaurant refused to settle the claim before a lawsuit was filed. The case ultimately was resolved at mediation shortly before the trial was to begin in Clark County, Indiana.

Diane W., a Wisconsin woman vacationing in Louisville, Kentucky, for the Derby, was injured while walking on a sidewalk located next to a mall.
