Spine Injuries

A spinal cord injury can be one of the most serious and life-altering injuries that an auto accident victim can suffer. An injury to the spinal cord can impair, interfere with or sever the nerves protected by the spinal column vertebrae. This can result in functional loss or debilitating pain, and sensation in those areas may be impaired or completely shut down.

Representative Spinal Cord Injury Cases

The following case summaries are auto accident cases resulting in spine injuries we have personally handled and litigated. They are provided for illustrative and informational purposes only, and are not meant to offer legal advice or intended to take the place of consultation with a qualified attorney with the requisite expertise and experience in these matters. These cases are only a sampling of the actual cases we have handled. While some cases may be similar, each case involves unique parties and specific facts, and the application of those facts to the controlling law may differ significantly depending upon the circumstances. No results or outcomes can be guaranteed in any case.

Henry S.

Henry S. was stopped at an intersection when the light turned green, and he began driving east on Dutchmans Parkway in Louisville, Kentucky. Shortly thereafter, another vehicle struck the driver’s side of Henry’s vehicle as it ran the red traffic signal light, failing to yield. Henry was transported by ambulance to Norton Suburban Hospital.

Thereafter, Henry began treatment at Chambers Medical Group and was diagnosed with cervical sprain/strain, thoracic sprain/strain and lumbar sprain/strain. Further diagnostic testing revealed nerve root compression, central disc protrusion, canal stenosis and disc bulging, requiring surgical intervention. We were retained by Henry to pursue personal injury claims against the at-fault driver’s insurance company, Allstate.

A lawsuit was filed in Jefferson Circuit Court. We obtained the policy limits of $50,000 for Henry. Because Henry had extensive medical expenses, we were also able to obtain an additional $50,000 from Henry’s underinsured (UIM) motorist coverage through direct negotiation with Henry’s UIM insurer, resulting in a total settlement of $100,000.

Michael C.

Michael C. was a resident of LaGrange in Oldham County, Kentucky, and employed by the Louisville Water Company when he was injured in a car accident. The collision occurred when a truck owned and operated by the Commonwealth of Kentucky rear-ended the back of Michael’s pickup truck. Michael C.’s truck sustained less than $700 worth of physical damage from the crash, but Michael suffered a severe injury to his spine as a result of rising up in his seat and striking the truck ceiling. As a result of the crash, Michael was treated by a neurosurgeon who diagnosed him with a disc herniation and performed a cervical discectomy and fusion. Michael’s total medical bills were $50,281.14. Michael also had significant lost wages reflecting his time spent recuperating from the neck surgery. This case settled without the lawsuit being filed after extensive negotiations with Traveler’s Insurance Company. This case settled for $175,000.
